Your purchase of our products and/or services implies that you have read and accepted these Terms and Conditions.

Only persons aged eighteen years or over may agree to these terms and use the web site or the services offered through the web site.
We may modify these terms at any time. We will post the modified terms on the web site. The modified terms will come into effect as soon as they are posted on the web site and use of the web site (or of any services provided through the web site) after that point will be subject to the modified terms.
Payment
Wallspice does not offer credit terms and all items must be paid for when ordered. We accept all major credit cards through our online Paypal payment facility.
Colour
Whilst we try our very best to provide consistent colour matching across our website and printed items, we cannot be held responsible for exact colour matching requirements. Colours may appear differently on your computer screen than ours (due to contrast and hue settings on your monitor) and we will not accept returns for colour related issues. If exact colour matching is important then we suggest contacting us to discuss test samples.

This site contains links to other sites. We cannot be responsible for the privacy policies and practices of other web sites. We recommend that you check the policy of each site that you visit.
Copyright and Intellectual Property Rights
All of the designs and concepts shown on the Wallspice website, including their intellectual property rights, belong to Wallspice, through Designworld Limited. Wallspice and Designworld Limited takes copyright infringement very seriously and will pursue theft or abuse of this vigorously.
No part of these designs may be reproduced without the express permission of the copyright holder.
If a customer supplies Wallspice with an image or text to use in a design, it is the sole responsibility of the customer to ensure that any image or text that they present for transformation into a print or canvas is copyright free or that the copyright is owned by the customer themselves. We will take no responsibility for any breach of copyright caused through printing an image or text supplied by a customer.
All website text, graphics and images and the designs of the products within the website are under strict copyright © Wallspice. You may not modify or replicate any item in any way without permission. You are not permitted to copy (whether by printing off onto paper, storing on disk or in any other way), distribute (including distributing copies), alter or tamper with in any way or otherwise use any material contained in this website.
Unsuitable Material
Wallspice reserve the right to refuse to produce an item and cancel that order and refund all monies paid if any personalisation requested on an item is, in our opinion, unsuitable. This might include (but is not limited to) pornographic, obscene or libelous content.
Production
Each Wallspice print and canvas is made to order and will normally be dispatched within 14 working days of cleared payment. Once your order and payment have been received, we will create your personalised design and email a proof to you for you to approve within 3 working days. Once we receive your approved proof back by email we will print your item and you should receive it within 10 working days. We will not accept responsibility for any spelling mistakes or colour differences once your design proof has been signed off by you via email.
Cancelling an Order
Once an order has been paid for we will start production on your item. If you need to cancel an order a 10% administration charge will occur if you cancel before we have started artworking your item. A 50% administration charge will occur if you cancel once we have artworked and proofed your item to you. Once we have printed your item you cannot cancel an order.
We normally start printing 2-3 working hours after your proof has been approved.
Delivery
Delivery is from the UK.
UK Delivery
Delivery is FREE within the UK on all of our items. Prints are wrapped in tissue paper and packaged in a strong cardboard tube. Canvases are wrapped in bubble wrap and packaged in strong corrugated cardboard. Items are usually dispatched within 10 working days of your proof approval, however you should allow up to 14 days delivery time. We cannot be held responsible for any late, lost or unforeseeable event caused by a delivery date not being met. Items are posted by 'Royal Mail Recorded Signed For', 'Royal Mail First Class Signed For Parcels' or by Parcelforce, depending on order size.
All packages will require a signature upon delivery, so whenever you can, please use a delivery address where you know someone is going to be available during the day. We can deliver to an address other than the billing address, so it might be a good idea to give a work address if no one is at home during the day. You shall be deemed to have accepted the goods after receiving delivery.
International delivery
International orders for prints are sent by Royal Mail Airsure, which includes tracking. We can provide a tracking number on request. International orders for canvases are sent by Parcelforce Worldwide.
Wallspice does not charge customs duties on overseas shipments. If any additional customs charges are incurred during your shipment, they are not calculated or monitored by us nor are they the responsibility of Wallspice. We recommend that you check with your local customs officials or post centre for more information regarding importation taxes/duties that may be applicable to your online order with us. If customs fees are payable, and you refuse to pay them, your order will be returned to us and we will be charged the customs fees plus return shipping costs. In such a case we will deduct any charges incurred, customs fees and shipping costs before a refund is issued.
Risk and Title
The Products will be at your risk from the time of delivery.
RETURNS AND REFUNDS
We want you to be happy with your purchase, so if you ever have a problem with any of our products please let us know and we’ll do whatever we can to make it right, but please be aware that all Wallspice products are made to order and so we cannot offer a money back guarantee or refunds on personalised items unless damaged during transit. Distance selling regulations do not apply to personalised items.
As part of the design process for a personalised item you will be required to approve a design proof. Once you have approved this proof by email, refunds cannot be made.
We want you to be completely satisfied with your purchase and we ensure all our products are quality checked before dispatch from our studio. In the unlikely event that any damage should occur during transit, please notify us within 3 working days by email at askus@wallspice.co.uk. Damaged goods will be replaced free of charge as soon as possible. Photographic evidence may be requested or you can return the damaged item to us. You will have to meet the delivery costs of returning the products, although we will refund the postage at our discretion once the item in question is rechecked. If we are at fault then we will gladly reimburse your postage costs. We will only acknowledge returned goods if they are sent using Royal Mail Signed For Recorded or Special Delivery so you have proof of delivery. Please don't send back your item without contacting us first as we will not accept returns without prior agreement and will only accept returns due to damage in transit if we have been contacted by email within 3 days of receipt. On receipt of the returned item we will print a new canvas or print and have that delivered to the same address as the initial order.
Privacy Policy
Whilst we will need to take certain personal details such as contact and delivery information we will never pass this information over to any 3rd party (except for the needs of product delivery). All personal information will be kept in a secure environment and not be accessible via the internet.
We do retain the right to use photos of your items as examples on our website. If you would not like you artwork displayed please contact us and we will remove it.
Please note that we do not store credit card details, nor do we share customer details with any third parties. We take the privacy of all our users and customers very seriously. When you input information, or request services from us, we have strict security procedures covering the storage and disclosure of your information (although we do not warrant that this is the case) in order to prevent unauthorised access to comply with the UK Data Protection Act of 1998. This means that sometimes we may ask for proof of identity before we disclose personal information to you. This privacy statement sets out how we will treat your personal information and forms part of the Terms and Conditions of this site.
The information that we hold about you may be used by us to contact you (either in writing, by post, by fax or by e-mail) about changes to our website, our products and services. If you do not wish us to use your information in this way please e-mail us at askus@wallspice.co.uk. We may collect information about your tastes and preferences both when you tell us what these are and by analysis of website traffic, including by using cookies. Most browsers accept cookies automatically, but usually you can alter the settings of your browser to prevent automatic acceptance. If you choose not to receive cookies you will be unable to order through the site.
We may use information collected about you to help us (a) develop the design and layout of our website to ensure that it is as useful and enjoyable as possible and (b) to inform you of goods, services and special offers that may be of interest to you. You agree that you do not object to us contacting you for any of the above purposes whether by e-mail, fax, telephone or in writing, and you confirm that you do not and will not consider any of the above as being a breach of any of your rights under the Telecommunications (Data Protection and Privacy) Regulations 1999. If you are under 18 years old, you must give us the email address of your parent or guardian. We will contact them to tell them that you are giving us personal data and to obtain any necessary consents from them.
To comply with applicable laws and lawful government requests, we reserve the right to access and disclose individually identifiable information to operate our systems properly or to protect our users or ourselves. We also reserve the right to disclose individually identifiable information to third parties where a complaint arises concerning your use of our website, and that use is deemed by us inconsistent with the Terms and Conditions. We reserve the right to pass on your personal information to any law enforcement agencies requesting it in connection with the commission of any offense, once we are reasonably satisfied as to the circumstances surrounding the request.
Collection and Use of Personal Information
You can view the Wallspice website without revealing any personal information. However, we need certain personal information if you wish to purchase our products, receive our newsletter, or use certain services. Where required, this information may include your personal contact information. Wallspice will use this information to reply to your enquiries, to provide you with requested products and services and to contact you regarding new products and services. By voluntarily providing Wallspice with the requested personal information, you consent to the collection and use of the information in accordance with this privacy policy.
Collection and Use of Non-Personal Information
The Wallspice website automatically receives and records non-personal information on our server logs from your browser including your IP address, cookie information and the page you requested. We may use this information to customize the content you see and to fulfill your requests for certain products and services. However we do not connect this non-personal data to any personal information collected from you.
Information Sharing and Disclosure
Wallspice will disclose your personal information to third parties who work on our behalf to provide products and services requested by you. We will share personal information for these purposes only with third parties whose privacy policies are consistent with ours or who agree to abide by our policies with respect to personal information. We may otherwise disclose your personal information when:

- We need to protect the personal safety of the users of our websites or defend the rights or property of Wallspice;

If you have provided personal information to Wallspice and no longer consent to its use or disclosure as outlined herein, please notify us.

Unfortunately, no data transmission over the Internet can be considered 100% secure. However, your information is protected for your privacy and security. Certain areas of our website, as identified on the site, use industry-standard SSL-encryption to protect data transmissions.
We also safeguard your personal information from unauthorized access, through access control procedures, network firewalls and physical security measures.
Further, Wallspice retains your personal information only as long as necessary to fulfill the purposes identified above or as required by law.
Changes to this Privacy Policy
Wallspice may at any time, without notice to you and at its sole discretion, amend this policy from time to time. Please review this policy periodically. Your continued use of our website after any such amendments signifies your acceptance thereof.
Warranty
Our products are provided "as is" without warranty of any kind, either expressed or implied. In no event shall our company or its agents be liable for any damages including, but not limited to, direct, indirect, special, punitive, incidental or consequential, or other losses arising out of the purchase of our products.
Law and Jurisdiction
These terms (and the provision of goods and services by us) are governed by and to be interpreted in accordance with English law. In the event of any dispute arising in relation of these terms or in relation to the provision of any goods and services by us the English courts will have exclusive jurisdiction over such dispute.
Events Outside our Control
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (Force Majeure Event).
A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following: Strikes, lock-outs or other industrial action. Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war. Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster. Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport. Impossibility of the use of public or private telecommunications networks. The acts, decrees, legislation, regulations or restrictions of any government. Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.
